If you purchased from the Acerbis website as a natural person acting for purposes which are outside his or her trade, business, craft or profession, pursuant to Article 52 of the Consumer Code, you have a period of fourteen natural calendar days to withdraw from the contract concluded with Acerbis and to obtain a refund of the expenses incurred, in accordance with the terms and conditions set forth below.
The withdrawal period ends after 14 days starting from:
1. from the day on which you or a third party other than the carrier acquires physical possession of the product;
2. in the case of multiple goods ordered by means of a single order with separate deliveries, from the day on which yu or a third party other than the carrier acquires physical possession of the last good
3. in the case of an order for delivery of a product consisting of multiple lots or pieces, from the day you or a third party other than the carrier acquires physical possession of the last lot or piece.
To exercise your right of withdrawal, you must inform us of your decision to withdraw from this contract by means of an express declaration before the end of the withdrawal period. For this purpose you may:
(a) use the withdrawal form on the website by using the link RETURN REQUEST FORM or
(b) submit any other express declaration of your decision to withdraw from the contract.
The withdrawal form or the declaration of withdrawal must be sent, depending on the means used, to the following addresses
by registered mail(post) with return receipt to Acerbis Italia Spa Via Serio 37, 24121-Albino (BG);
or
by using the link "make a return" present inside the relevant purchase order in your reserved area and selecting the option "I changed my mind".
In order to respect the withdrawal period, it is sufficient for you to send the communication concerning the exercise of the right of withdrawal before the expiry of the withdrawal period
Please note that the burden of proof concerning the exercise of the right of withdrawal before the end of the withdrawal period lies with the consumer and, therefore, is on you.
Once the return request is received, you will be sent an e-mail within the next working day with a link through which you will be requested to enter your data, in order to have the courier collecting it at your home address.
As an alternative, it is possible to select the option "take it to a service point" and bring your return directly to one of the following collection points, which can be consulted on the website: https://locator.dhl.com/
In both cases (pick-up at your home or take it to a service point), you must print out the return label and affix it to the product package, which must be returned undamaged and carefully packed using the original packaging. The link will also be made available to you in the returns section in your reserved area.
The estimated return cost may amount to a maximum of approximately € 9.95 (euro four/95). This cost will be deducted off any reimbursement of the goods for withdrawal.
The product must be returned without undue delay and in any case within the term of 14 calendar days from the date on which you communicated your decision to withdraw from the contract. The deadline is met if you entrust the product to the DHL courier or at a DHL service point before the expiry of the 14-day period or make it available for collection. Moreover, the withdrawal applies to the product in its entirety and cannot, therefore, be exercised in relation to parts and/or accessories of the product itself while it can also be exercised in relation to a product in the case of multiple goods ordered in a single order.
We inform you that in accordance with the law, the use/manipulation of the product by you necessary to verify its nature and characteristics is permitted, therefore, you are only liable for the decrease in the value of the goods resulting from any handling of the goods other than that necessary to establish the nature, characteristics and functioning of the goods.
The product must therefore be stored, handled and inspected with normal diligence and returned intact, complete in all its parts, fully functional, complete with all accessories and illustrative sheets, with the identification tags and labels still attached to the product, intact and not tampered with, as well as perfectly fit for its intended use and without signs of wear or dirt.
In the event that the product for which the withdrawal has been exercised is not returned in the conditions envisaged, without prejudice to the possible ineffectiveness of the withdrawal as envisaged below, the amount of the refund shall be reduced by the amount equivalent to the reduction in value of the returned goods. If the refund has already been paid, you will be notified of the bank details for payment of the amount owed by you due to the decrease in value of the returned product.
If the withdrawal is exercised in accordance with the above, Acerbis will proceed to refund all payments you have made, including delivery costs (with the exception of additional costs arising from your choice of a type of delivery other than the least expensive type of standard delivery offered by Acerbis), without undue delay and in any event no later than 14 days from the day on which we are informed of your decision to withdraw from this contract. Such refunds will be made using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any costs as a consequence of such a refund. In the event that there is no correspondence between the recipient of the products and the person who made the payment of the sums due for their purchase, the reimbursement of the sums, in the event of the exercise of the right of withdrawal, shall be made by Acerbis, in any case, towards the person who made the payment.
We inform you that, pursuant to Article 56 of the Consumer Code Acerbis may withhold the refund until it has received the goods or until you have proved that you have sent back the goods, whichever is sooner.
In the event that the withdrawal has not been exercised in accordance with the applicable law and the above conditions, the contract of sale shall remain in force and you shall not be entitled to any refund.
Acerbis will inform you by rejecting the withdrawal request.
If the product has already been received by Acerbis, it will remain with Acerbis at your disposal for collection at your expense and responsibility. In the event that you do not collect the product Acerbis reserves the right to retain the goods and the corresponding purchase price.
Please note in any case that, pursuant to Article 59 of the Consumer Code, the right of withdrawal is excluded, inter alia, in the event that the sale relates to:
(i) made-to-measure or clearly customised products
(ii) sealed products that cannot be returned for hygienic or health protection reasons, which have been opened after delivery.
